The unitary patent system will enter into force on June 1, 2023 with an aim of protecting patent rights across all participating European jurisdictions with a single filing, a single renewal fee and a single court, the so-called Unified Patent Court.

 

The Unitary Patent will not apply to countries that are not part of the European Union (“EU”), and this currently excludes Norway, Switzerland, Turkey, and the United Kingdom from the Unitary Patent. It likewise (currently) excludes EU countries that have not yet agreed to take part in the unified system, such as Croatia, Poland, and Spain, as well as countries that has not yet ratified the Agreement. 


The Unified Patent Court is an international court set up by all participating EU Member States to deal with the infringement and validity of both Unitary Patents and earlier European patents, aiming at putting an end to costly parallel litigation and enhancing legal certainty. Thus, the UPC seeks to provide a simplified system so that a single infringement or revocation action may be filed instead of requiring separate actions to be filed in every country where the European patent is in force (validated).
